Terms of Service

These Terms of Service ("Terms") govern your use of Tradies Nation ("Service", "we", "us", "our") operated by ABN 50511946876.

By using our Service, you agree to these Terms. If you disagree with any part, do not use our Service.

1. Service Description

Tradies Nation is a connection service that connects customers with verified trade professionals in Australia.

We are NOT:

  • A directory or listing service where customers browse tradies
  • A marketplace where tradies bid on jobs
  • A party to any contract between customers and tradies
  • An employment agency or employer of tradies

How it works:

  • Customers submit job requests
  • We connect customers with verified tradies in their area
  • Customers and tradies work together directly
  • Tradies pay a platform fee after job completion

2. Terms for Customers

2.1 Using the Service

When you submit a job request, you agree to:

  • Provide accurate and truthful information
  • Respond to tradies in good faith
  • Not use the Service for illegal purposes
  • Not submit false or spam requests

2.2 Customer Fees

Our Service is FREE for customers. We do not charge customers any fees. Any tradie who adds our platform fee to customer prices violates our Terms and will be removed immediately.

2.3 No Guarantee

While we verify all tradies, we do NOT:

  • Guarantee the quality of work performed
  • Guarantee pricing, timelines, or outcomes
  • Supervise or oversee tradie work
  • Act as a party to contracts between you and tradies

You are responsible for:

  • Checking tradie credentials before engaging them
  • Agreeing on scope, price, and timeline in writing
  • Ensuring proper contracts are in place
  • Resolving disputes directly with the tradie

2.4 Your Rights Under Australian Consumer Law

Nothing in these Terms limits your rights under the Australian Consumer Law (ACL). When engaging a tradie, you have rights including that services must be provided with due care and skill, fit for purpose, and completed in a reasonable time.

3. Terms for Tradies

3.1 Eligibility

To join our network, you must:

  • Hold all required licenses for your trade in your state/territory
  • Maintain current public liability insurance ($5M minimum)
  • Have a registered ABN and business structure
  • Provide verifiable references
  • Pass our vetting process

3.2 Platform Fees

Tradies pay a platform fee of 10% up to a maximum of $300 per completed job.

Fee Structure:

  • $500 job = $50 fee (10%)
  • $2,000 job = $200 fee (10%)
  • $5,000+ job = $300 fee (capped, ~6% or less)

When You Pay:

  • AFTER job completion
  • AFTER customer has paid you
  • Within 14 days of job completion

When You DON'T Pay:

  • If you quote but don't win the job
  • If customer doesn't pay you
  • If job is cancelled before starting

3.3 CRITICAL RULE: Do NOT Add Platform Fee to Customer Prices

ZERO TOLERANCE POLICY:
The platform fee is YOUR cost for using our service. It is NOT the customer's cost. Any tradie who adds this fee to customer prices will be immediately removed from our network. No warnings. No exceptions.

3.4 Obligations

As a tradie in our network, you agree to:

  • Maintain current licenses and insurance at all times
  • Respond to customer connections within 48 hours
  • Provide honest quotes and professional service
  • Complete work to industry standards
  • Pay platform fees within 14 days of job completion
  • Notify us of any complaints or disputes
  • Keep your contact details and coverage areas up to date

3.5 Removal from Network

We may remove you immediately for:

  • Adding platform fees to customer prices
  • License or insurance lapsing
  • Pattern of customer complaints
  • Fraudulent behavior or misrepresentation
  • Non-payment of platform fees
  • Violation of these Terms

4. Liability and Disclaimers

4.1 Our Liability

Tradies Nation is a connection service only. We are NOT liable for:

  • Quality of work performed by tradies
  • Disputes between customers and tradies
  • Property damage or personal injury
  • Financial losses from connections made through our Service
  • Tradie conduct, including fraud or negligence

4.2 Service Availability

We do not guarantee:

  • Uninterrupted or error-free service
  • Specific response times
  • Availability of tradies in all areas
  • That connections will result in completed work

4.3 Third-Party Liability

Tradies are independent contractors, not our employees or agents. We are not responsible for their actions, omissions, or conduct.

5. Dispute Resolution

Between Customers and Tradies: Disputes about work quality, pricing, or outcomes must be resolved directly between you and the tradie. We may assist with mediation but are not obligated to do so.

With Tradies Nation: For disputes with us, first contact legal@tradies.jack1001.ai. If unresolved, disputes will be governed by Australian law and courts of competent jurisdiction in Australia.

6. Complaints

Customer complaints about tradies should be emailed to complaints@tradies.jack1001.ai with:

  • Tradie details
  • Description of the issue
  • Supporting documentation

We will investigate and may remove tradies for serious or repeated complaints.

7. Intellectual Property

All content on Tradies Nation (text, graphics, logos, design) is owned by us or licensed to us. You may not copy, reproduce, or distribute our content without written permission.

8. Privacy

Your use of our Service is also governed by our Privacy Policy. Please review it at /privacy.html

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Service after changes constitutes acceptance of new Terms.

Material changes affecting tradie fees or obligations will be communicated via email with 30 days notice.

10. Termination

Customers: You may stop using our Service at any time.

Tradies: You may request removal from our network by emailing getwork@tradies.jack1001.ai. Outstanding platform fees must be paid before removal.

We may: Suspend or terminate access to our Service at any time for violations of these Terms or at our discretion.

11. Governing Law

These Terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of courts in Australia.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tradies Nation regarding use of our Service.
